Flavour Creations Pty Ltd (Flavour Creations, we, us, our) cares about privacy issues and wants you to be familiar with how we collect, disclose and otherwise use and process information about you.
Introduction to our Privacy Policy
Flavour Creations is bound by and committed to managing personal information in accordance with the Australian Privacy Principles and the Privacy Act 1988 (Cth) (Privacy Act).

By interacting with us including ordering product, contacting us by phone, email or in person or by accessing our websites, social media pages and/or software applications (our Services) you accept the terms of this Privacy Policy.

What Information Is Collected?
Information you specifically give to us
We may ask you to provide us with certain types of personal information if you wish to obtain a particular service or product from us. This might happen over the telephone, through our website, by filling in a paper form, or meeting with us face-to-face. We will give you a Collection Notice at the time, to explain how we will use the personal information we are asking for. The notice may be written or verbal.
If you participate in “Flavour Creations at Home” please refer to the Patient Privacy Collection Notice which sets out specific privacy details in relation to this program.
Unsolicited information
You might also provide your personal information to us, without us directly asking for it, for example if you engage with us on social media. If we receive personal information about you without it being requested, it will be treated in the same way as any other personal information.
Information that we collect from others
If you apply for a job or contract with us, we will collect personal information about you from your referees. With your consent we may also use a third-party service to ensure your employment, educational and identity records are valid. At times we contact the Australian Health Practitioner Regulation Agency (AHPRA) and may also check some details about our suppliers, customers or contractors from publicly available sources, such as the Australian Business Register and ASIC databases.
Information we generate ourselves
We maintain records of the interactions we have with you, including the products and services we have provided to you, education that has been provided for you and complaints that have been made. We collect limited information about users of our websites, for diagnostic and analytic purposes and explain this in more detail below.
Examples of personal information
Examples of personal information that we may collect includes the following:
- contact details (such as name, postal address (including billing and shipping addresses), phone number and email address);
- payment details (credit or debit card number);
- financial information in certain circumstances;
- social media account information;
- geolocation information;
- communication, product, service or other preferences;
- your opinions, comments, suggestions, inquiries and other communications you provide to us;
- demographic information;
- audio/visual recordings such as when you call our customer service phone number or participate in having a photo taken;
- internet click activity on our websites;
- IP address or device ID and other statistical data;
- in the case of healthcare professionals, your associated health service or hospital and department;
- the name and details of a carer or guardian (if applicable);
- Government identifiers (such as NDIS number); and
any other information that you provide to us or authorise us to collect as part of our Services or interactions with you.
Sensitive information
In order to provide our Services or information about our products, we may also collect personal health information (such as information you disclose about a medical condition or disability) or other important information that you provide to us that may be relevant to the way we provide our Services to you. This information may amount to “sensitive information” as defined in the Privacy Act and will be handled in accordance with this Privacy Policy and applicable laws.
Any sensitive information collected by us will only be used or disclosed for the primary purpose for which it was collected (for example, informing you about our products and nutrition solutions). If we intend to use your sensitive information for another purpose we will seek your separate explicit consent.
How do we collect personal information?
Direct interactions
We collect information from you in a variety of ways, including (without limitation) when you interact with us electronically or in person, order or take delivery of a product, make a payment, participate in an offer, promotion or survey, join a loyalty or other program, access our website, interact on our social media pages (i.e “Like” or “Follow” a post), apply for a job, apply for a role as a volunteer, contact us with a question or request, provide a testimonial or story, or submit a photo, review or comment.
‘Cookies’, automated technologies or interactions
We may use cookies, web analytics tools (including Google Analytics) and similar tracking technologies to track activity on our website, for better targeting advertisements and for marketing purposes. Cookies are digital identifiers that are stored on your computer. We may collect certain information such as your device type, browser type, IP address, pages you have accessed on our websites and third-party websites as well as accessing cookies stored on your computer that were created by third parties. It is possible that you may be either directly or indirectly identifiable from this information. You can use the settings in your browser to control how your browser deals with cookies. However, in doing so, you may be unable to access certain pages or content on our website.
Third parties
In certain circumstances, it may be impracticable for us to collect personal information from you directly, for example, where your carer or healthcare professional orders a product on your behalf, or registers you for one of our programs such as “Flavour Creations at Home”. We will usually notify you about these instances in advance, or where this is not possible, as soon as is reasonably practicable after the information is collected.
If you provide personal information about a third-party individual to us, you must ensure that the third-party individual is aware of this Privacy Policy, understands it and agrees to accept it. If you provide personal information about a third-party individual and that individual does not have the capacity to understand and agree to these terms you warrant that you are authorised to disclose that information to us for our collection, use and disclosure for the purposes set out in this Privacy Policy.
Purpose of collection
We collect personal information as reasonably necessary to provide our Services to you, including (without limitation):
- fulfilling a product order and providing after sales service;
- providing Services to you or someone else you know such as a carer or guardian;
- providing you with information about other Services that we and other organisations that we have affiliations with, offer that may be of interest to you;
- facilitating online training or information about our products and programs including “Flavour Creations at Home”;
- complying with legal or regulatory obligations;
- analysing our Services and customer needs with a view to developing new or improved services;

- contacting and communicating with you including responding to queries, complaints and feedback from you;
- ensuring the proper functioning of our website, our business and operations;
- assisting us with marketing, product and service development and research requirements;

- advertising and marketing our products and services.
If the personal information you provide to us is incomplete or inaccurate, we may be unable to provide you, or someone else you know, with the Services you, or they, are seeking.

If the General Data Protection Regulation applies, our lawful basis for collecting and using the information described in this Privacy Policy will depend on the information concerned and the specific context in which we collect or use it.
We normally collect or use information from you where we have your consent to do so, where we need the information to perform a contract with you or to provide our services or products to you upon your request, or where the processing is in our legitimate interests and not overridden by your data protection interests or rights and freedoms.

- use information to effect a transaction you have requested, we need it in order to provide you with the products you are purchasing;
- use names and email addresses for email marketing purposes, we do so with your consent (which you can revoke at any time); and

Use and disclosure
Service providers
We may disclose your personal information to third party service providers who assist us to provide Services to you, including ‘in the cloud’, and that may host data on our behalf or provide CRM services.
This may include our related entities and other organisations with whom we have affiliations so that those organisations may provide you with information about services and various promotions.
Payments
We use third-party payment processors, including Stripe and PayPal, to process payments made to us. When you make a payment, your personal information (such as your name, billing details and payment information) is collected directly by these payment providers in accordance with their respective privacy policies.
Permitted disclosures
We may also disclose your personal information to third parties for the following purposes:
- if necessary to provide the service or product you have requested;
- if otherwise permitted or we believe it is required by law;
- for other purposes with your consent; or
- if there is a change of control in our business (for example a sale of the business) your personal information could be disclosed to a potential purchaser under a confidentiality agreement.
Social Media
When you use Flavour Creations social media pages, you are using an external site and are therefore bound by the privacy principles of that site. We encourage you to review the privacy policies of that site for further information. Flavour Creations does not endorse, and is not accountable for, any views expressed by third parties using that site.
Flavour Creations records all information posted to the Flavour Creations social media channels and uses that information for the purpose of administering the channels, for record keeping and for considering and/or addressing any comments made. No attempt will be made to further identify social media subscribers except where requested and authorised by law.
Flavour Creations also uses interfaces with social media sites such as Facebook, LinkedIn, Twitter, GooglePlus and others. If you choose to “like” or “share” or “recommend” information from this website through these services, you should review the privacy policy of that service. If you’re a member of a social media site, the interfaces may allow the social media site to connect your visits to this site with other personal information.
Email and Direct Marketing
When you provide us with your contact details, you give your consent to us using your personal information to provide you with information and to tell you about things which we consider may be of interest to you, including by post, email, SMS, messaging applications and telephone (Direct Marketing Communications). We may use third-party service providers to assist with Direct Marketing Communications, including email marketing platforms such as Otto. These providers may store and process personal information such as names, email addresses and engagement data on our behalf.
If at any time you do not wish to receive any further Direct Marketing Communications you may do this at any time by using the “unsubscribe” facility included in the Direct Marketing Communication or by contacting us at the details set out at the end of this document.
If you opt-out of receiving our Direct Marketing Communications, we may still contact you in relation to our ongoing relationship with you.
We will not provide your information to third parties for marketing purposes without receiving your consent.
Analytics and Reporting Tools
We use third-party service providers to assist with reporting and analytics, including Metorik for sales data and Google Analytics for website. These providers may access personal information such as names, email addresses and transaction details in order to provide reporting and business intelligence services to us.
Reports obtained from Google Analytics are used to help improve the efficiency and usability of this website.
Google Analytics uses first-party cookies and JavaScript code to gather statistics about how the website is accessed. It anonymously tracks how our visitors interact with this website, including where they came from, what they did on the site including such things as news registration. The information generated by the cookie and JavaScript code about your use of the website (including your IP address) will be transmitted to and stored by Google on servers located outside Australia. You access and use any linked website at your own risk. Storage and Security of Information
We store your personal information in different ways, including in paper and in electronic form, including WordPress. The security of your personal information is important to us. We will use all reasonable endeavours to keep your personal information in a secure environment, however, this security cannot be guaranteed. We have put in place various methods including firewalls, passworded access and encryption software to ensure your personal information is not subject to misuse, loss, unauthorised access, modification or disclosure. We will only retain your personal information for as long as is reasonably necessary in relation to the purposes for which it was collected. If we no longer need your personal information, unless we are required under Australian law or a court or tribunal order to retain it, we will take reasonable steps to destroy or de-identify your personal information if it is no longer needed for its purpose of collection.
Any personal information collected and held by us may be disclosed to, and held at, a destination outside of Australia. Some of our third-party service providers, such as Stripe, PayPal, Google and Metorik, may store or process personal information overseas, including in the United States and other countries in accordance with their respective privacy policies. By providing your personal information to us, you expressly consent to the disclosure, transfer, storing or processing of your personal information outside of Australia. We take such steps as are reasonable in the circumstances to ensure that any recipients of your personal information outside of Australia are bound by privacy principles equivalent to those contained within the Privacy Act or agree to meet the requirements of the Privacy Act.
Important notice: You consent to us providing your personal information to recipients outside of Australia even though that recipient is not bound by the Privacy Act, will not be accountable to you or to us for breaches of the Privacy Act and you will not have the redress options available to you under the Privacy Act. Doxxing and Unauthorised Disclosure
Doxxing refers to the publication or disclosure of an individual’s personal information without consent with the intent or effect of causing harm, harassment, intimidation or distress. We will not knowingly collect, publish or facilitate the publication of personal information in a way that could lead to harm or harassment. In addition, we strictly prohibit any use of our Services to dox, expose or maliciously share an individual’s personal information. This includes sharing private or identifying information without consent, encouraging others to target a person based on shared data or uploading or linking to content designed to expose someone’s identity against their will.
We will take all reasonable steps to remove or restrict access to any personal information that is disclosed in breach of this Privacy Policy or the Privacy Act.
